These General Terms and Conditions of Sale (GTC) apply to all sales of products and services offered by ROADLOOP on the bugfatal.com website, intended for consumers and professionals.

Subscriptions and licenses various

ARTICLE 3 - PRODUCTS AND SERVICES

3.1 Software

Perpetual licenses : One-time purchase of a specific version with technical support for 1 year
Monthly/annual subscriptions : Continuous access with included support
Activation : Requires internet connection for license validation

3.2 Physical items

Derivative products, gaming and geek accessories listed in our shop.

3.3 Technical support

Duration : 1 year for perpetual licenses, included in subscriptions
Methods : Via our ticket system (bugfatal.com/support)
Phone contact : On request via support

ARTICLE 4 - PRICE AND PAYMENT

4.1 Prices

All prices are displayed VAT inclusive in euros
For physical products: shipping costs included (standard EU delivery)
Occasional discounts available on bugfatal.com/coupon

4.2 Payment methods

Secure payment by Stripe :

Recurring payments : Bank cards only
One-time payments : Bank cards, PayPal, Klarna, Alipay, WeChat Pay, Giropay, iDEAL, Bancontact, EPS, Sofort

4.3 Installment payment

Available according to our payment partners' terms (managed directly by Stripe).

ARTICLE 5 - ORDER AND DELIVERY

5.1 Digital products (software)

Delivery : Immediate by email + client area
Activation : License number or connection with site credentials
Access : Immediate after payment validation

5.2 Physical products

Delivery time : According to selected carrier
Delivery zone : Mainly European Union
Non-EU deliveries : Possible with specific shipping costs calculation
Carrier : Selected by us to optimize quality/price ratio
Tracking : Tracking number provided by email and SMS

5.3 Delivery delay

In case of delay exceeding 30 days, the customer can request cancellation and refund within 14 days.

ARTICLE 6 - RIGHT OF WITHDRAWAL

6.1 Physical products

Period : 14 days from receipt
Terms : Return at your expense, product in perfect condition
Refund : Within 14 days after receipt of return

6.2 Digital products

The right of withdrawal is excluded as soon as the customer:

Activates their software license, OR
Uses the service/software

This exclusion complies with Article L221-28 of the Consumer Code.

ARTICLE 7 - SUBSCRIPTIONS AND TERMINATION

7.1 Customer termination

Method : From the client area (one click)
Effect : Immediate, without notice
Billing : Until the end of the period already billed
Refund : No pro-rata refund

7.2 Our termination

In case of non-payment: immediate suspension of access to services.

ARTICLE 8 - WARRANTIES

8.1 Legal warranty of conformity

In accordance with Articles L.217-4 et seq. of the Consumer Code, we guarantee the conformity of delivered goods for 2 years.

8.2 Warranty against hidden defects

Legal warranty in accordance with Articles 1641 et seq. of the Civil Code.

DIGITAL SERVICES CONFORMITY WARRANTY NOTICE

In accordance with Article L. 224-25-12 of the Consumer Code

Updates: Provided during support period
Security updates: Included during support period
Update impact: Performance improvement, bug fixes

ARTICLE 9 - LIABILITY

9.1 Limitation of liability

Our liability is limited to legal warranties
We do not guarantee the suitability of our software for specific needs
The customer remains responsible for data processed with our software

9.2 Force majeure

We cannot be held responsible in cases of force majeure or circumstances beyond our control.

ARTICLE 10 - INTELLECTUAL PROPERTY

10.1 Software

The software remains our exclusive property
Redistribution prohibited of our software
Use limited to the terms of the granted license
Restrictions : Use in compliance with laws in force in the user's country

10.2 Special authorization

Any particular use must be subject to prior written agreement.

ARTICLE 11 - PERSONAL DATA

The processing of your personal data is detailed in our Privacy Policy.

Marketing purposes: With your consent, we may use your data to offer commercial deals without spam or harassment. Unsubscribe at any time from your client area.

ARTICLE 12 - LATE PAYMENT PENALTIES (PROFESSIONAL CLIENTS)

For professional clients, in case of payment default:

Principle : Immediate service suspension
Payment : You pay, you access the service
No payment : No access to service

No late payment penalties are applied, the system being based on advance payment.

ARTICLE 13 - MEDIATION AND DISPUTES

13.1 Consumer mediation

In case of dispute, you can use a consumer mediator free of charge.

13.2 Competent court

In case of failed mediation, the courts of Thionville will have sole jurisdiction.

The nullity of one clause does not entail the nullity of other provisions.

These GTC are subject to French law.
